A man has just received a fine for medical malpractice which resulted in death. Justice in the world seems to be completely dead.

An elderly woman was given potassium tablets prescribed in such high doses that she died of poisoning after a few days. Two immigrant doctors were charged with a crime, but only one is convicted and gets away with a 50-day fine.

The elderly woman, whose name was Birgitta, was discharged on 5 February 2019 from Norra Älvsborgs Läns Hospital, where she was treated for influenza.

When she left the hospital, the head of the ward prescribed the potassium drug Kaleorid prolonged-release tablet 750 mg to be taken three times daily with 10 tablets at a time.

Four days after the deportation, Birgitta died of poisoning.

The ward doctor, a woman in her 35s, made the prescription in consultation with the chief doctor, a now 37-year-old man who comes from Iraq.

Uddevalla District Court today sentenced the chief physician for causing another person’s death, to a suspended sentence of 50 daily fines of SEK 1,000, but acquits the female doctor.

The court finds in the judgment that there is no reasonable doubt that the patient died as a result of the prescribed potassium drug and that the high prescribed dose poisoned the patient so that she died.

The district court concluded, among other things, that the prescription did not follow medical science and proven experience in caring for the potassium deficiency from which the patient suffered.

It was not questioned that the doctors had a very heavy workload, but this in itself was not considered to be able to deprive the doctors of their responsibility. However, the district court found that the female doctor, in view of lack of experience, could not be considered criminally negligent in her actions.

The district court does not agree with its assessment. A jury member is divided and wanted to acquit both doctors because she believed that alternative causes of death could not be ruled out.
