malmo district court

It took a week before it became known that Greta Thunberg had been charged. The district court had, without reason, marked the lawsuit confidential.

It’s easy to believe in conspiracy theories when things like this, says freedom of expression expert Nils Funcke to Sydsvenskan.

Greta Thunberg was charged on June 28 for disobedience to law enforcement at a climate action in the oil port in Malmö earlier this summer.

But it was only a week later, on Wednesday last week, that the media learned about the matter and could report on the indictment.

The information had been kept secret by the Malmö district court, which classified the prosecution as confidential.

Division judge Helena Tjörnstrand admits for Sydsvenskan that the confidentiality marking was incorrect. Her explanation is that it happened because Greta Thunberg has protected personal data, which, however, should not play any role in the context.

– We at the district court have made a mistake. I can only regret, of course, that shouldn’t happen, she says.

Nils Funcke, expert in the principle of publicity and freedom of expression, tells Sydsvenskan that it is a “serious mistake” to apply the confidentiality regulations in this way.

He believes that such events risk undermining the public’s trust in the courts and that people may realize that the judiciary treats people.

The Stockholm district court last spring blacked out the name of a moderate Riksdag who was blackmailed after buying sex. However, Fria Tider was able to reveal that the politician in question was M-top Kjell Jansson.
