The International Court of Justice (ICJ) delivered a landmark ruling on South Africa’s case against Israel, specifically addressing the situation in Gaza. In a historic decision issued on Friday, the court asserted its jurisdiction and imposed seven “emergency measures” requested by Pretoria. Despite not ordering Israel to halt its military operation against Hamas, the ICJ mandated the Jewish state to take all necessary actions to prevent genocide in Gaza.
The panel of 17 judges emphasized that Israel must refrain from committing genocide, punish military members involved in genocidal acts, penalize officials calling for Palestinian genocide, and preserve evidence of any such acts. Furthermore, the ruling stated that Israel should take immediate and effective measures to address adverse conditions in the Gaza Strip. West Jerusalem was given a month to report back to the court on its compliance with these measures.
South Africa, though not achieving all its demands, secured a significant victory with the ICJ’s ruling. The court’s decision, final and legally binding, dealt a blow to Israel’s attempt to dismiss the case entirely, labeling it as “spurious and specious.” Despite lacking enforcement mechanisms, the Palestinian Foreign Ministry hailed the verdict as an “important reminder” that no state is above the law.
Foreign Minister Naledi Pandor of South Africa expressed satisfaction with the outcome, stating that the primary aim was to “highlight the plight of the innocent in Palestine” and “draw attention to the lack of justice and freedom.” Regardless of the case’s future trajectory, Pandor asserted that Pretoria had already achieved its goals.
South Africa initiated the case in December, accusing Israel of violating the UN Genocide Convention by causing harm to Palestinians in Gaza and creating conditions leading to their physical destruction. The conflict escalated after Hamas attacked Israel, resulting in casualties and hostages. The subsequent Israeli military operation, criticized for its impact on civilians, has left a devastating toll on Gaza’s population and infrastructure.
