Federal judges often use hypothetical excuses to justify a police execution, such as, “the victim could have killed someone had the officers not fired upon him.”

It’s the “could have, would have” syndrome that makes the extrajudicial execution acceptable. “Someone” could have been hurt somehow, yet nobody was hurt.

This silly justification is a cover story for something the courts don’t want to deal with – the questionable decision by a police officer to kill.

It’s the same excuse used for having speed laws – someone MIGHT get injured even if the speeder has hurt no one. It’s all hypothetical, a speculation that harm might be foreseeable even if nothing happens. It is intellectual fraud.

I wrote inside a federal civil rights wrongful death lawsuit for the summary execution of an unarmed mentally ill individual in Minneapolis in November 2000

“in America, the non judicial, summary execution of American citizens is often viewed as constitional by many federal courts across America”

this sentence, placed inside a high district federal court in downtown Minneapolis by a plaintiff’s lawyer who was representing a dead man, and his family who had done no felony level crimes and hand harm no one and who worked for over 10 yrs inside a nursing home and was beloved there by everyeone who knew him

drew an immediate and seriously heavy immediate criticism from the presiding district court judge …who was assigned to hear the arguments…

he ordered me, to remove this sentence from within a public and federal civil rights brief which was arguing for the case to continue on past summary judgment based on the serious discrepancies we had found on the ballistic and witness and official accounts to this multiple office, 37 shots in less than 7 seconds by six officers against an unarmed mentally individual who died in this hail of gunfire, for no good apparent reasons in the back alley of North side of Minneapolis, after the police and a local college off duty security guard blocked him into this alley themselves…resulting his murder

the judge wrote I would be held in contempt asap if I did not remove this truthful but all too revealing statement from within a wrongful death police misconduct civil rights case brief

the judge was hostile as can be just because we mirrored back to the high court….what they would eventually hold

even in this particular case itself…
