The national guard is a state militia commanded by the governors of each state, not FEMA or DOD, with only one exception of when a governor consents to delegate his command to the Department of Defense. This normally happens only during wartime, such as in WW2, Korea, Vietnam, Iraq, Afghanistan.

Even if Congress could enact a law to transfer command of the guard, a governor could legally ignore it because the governor is the commander in chief of the national guard of his state and that authority can be altered only by the state legislature.

So what can we do if there are no rights left us.I guess folks are going to have to become inventive about what they need to do to protect themselves and their families.
